Terms of Service

Agreement

These Terms of Service ("Terms") are an agreement between you and WeatherVector ("we", "us" or "our"). They cover your use of the WeatherVector website, the web app, and the WeatherVector apps for iPhone, iPad, Android and Windows (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

You must be at least 13 years old to use the Service. If you're under 18, you need a parent or guardian's permission, and they must agree to these Terms for you, including for any purchase.

Weather information and your safety

WeatherVector is not an official source of weather warnings. Always follow the National Weather Service, your local emergency management officials and NOAA Weather Radio when making safety decisions. Have more than one way to receive warnings.

  • Weather data can be delayed, incomplete or wrong. Radar sites, data feeds, networks and our own systems can go down, sometimes during severe weather.
  • Storm arrival times, storm tracks, rotation and hail detection, the Vector Threat Index and similar features are automated estimates. They can miss real threats, flag threats that aren't there, and change quickly.
  • Push notifications aren't guaranteed. They depend on your device, its settings, your connection, the operating system and outside push services, and they can be late or never arrive.
  • Never use WeatherVector as your only source of information about a life-threatening situation.

Accounts

You can use much of the Service without an account. If you create one, give accurate information and keep your sign-in details secure. You're responsible for activity on your account. Tell us right away at help@weathervector.app if you think someone else has accessed it. One account is for one person. Don't share your account or your paid features with others.

Plans and payment

WeatherVector offers a Free plan and paid Plus and Pro plans. Each plan's features are described on our pricing page.

  • Automatic renewal. Plus and Pro are subscriptions that renew automatically each month or year, depending on what you choose, until you cancel. By subscribing, you authorize us or the app store to charge your payment method at the start of each billing period.
  • Where you pay. If you subscribe on our website, Stripe processes the payment. If you subscribe in the iPhone, iPad or Android app, Apple or Google processes it under their own terms. Billing, renewals and refunds for those purchases are handled by them.
  • Taxes. Prices may not include sales tax, VAT or other taxes, which will be added where required.
  • Price changes. We may change prices. We'll tell you ahead of time, and a new price applies starting with your next billing period after the notice. If you don't want to pay the new price, you can cancel before it takes effect.
  • Upgrades and downgrades. If you switch plans on the web, Stripe may charge or credit a prorated amount for the rest of your billing period.
  • Failed payments. If a payment fails, your paid features may be paused or end until payment goes through.
  • Feature changes. We may add, change or remove features in any plan. If we remove a major paid feature you rely on, you can cancel, and we'll consider a prorated refund on request.

Cancellation and refunds

  • Web subscriptions. Cancel at any time in the app: open Your plan and choose Manage subscription. Your plan stays active until the end of the period you already paid for, and then it won't renew.
  • App store subscriptions. Cancel in your Apple ID or Google Play subscription settings. Deleting the app doesn't cancel your subscription.
  • Refunds. Payments aren't refundable and we don't give credit for partly used periods, except where the law requires it or as stated in these Terms. If something went wrong, such as a duplicate charge, email us and we'll look at it. Refunds for app store purchases must be requested from Apple or Google.
  • Deleting your account. Cancel any web subscription before deleting your account. See Delete your account.

Streaming and broadcast use

Broadcast mode and the streaming overlay are made for live streams and videos. While your plan includes these features, you may show WeatherVector on your live streams, recorded videos and social posts, including monetized ones, under these conditions:

  • Keep the WeatherVector name and branding that appear on screen. Don't present the Service as your own software.
  • Don't tell your viewers that WeatherVector, or anything shown in it, is an official warning. Encourage them to follow the National Weather Service and local officials.
  • You're responsible for what you add on screen, including your lower-third, logo and commentary. You must have the rights to anything you upload.
  • Keep your overlay link private. Anyone with the link can view your overlay. You can choose Reset overlay key in Settings at any time, which turns off the old link.
  • Content you made with WeatherVector while subscribed can stay up after your plan ends.

Images you export, such as GIFs, videos and screenshots, may be shared under the same conditions. Television stations, networks and other commercial broadcasters need a separate written agreement with us. Email us to ask.

Acceptable use

Don't:

  • Break the law, or use the Service to harm, threaten, harass or mislead others, including by spreading false warnings.
  • Copy, resell, rent, sublicense or redistribute the Service or its data feeds, except as allowed in "Streaming and broadcast use".
  • Scrape the Service, or use bots or automated tools to pull data from it, beyond normal personal use.
  • Get around plan limits, paywalls, security features or usage limits.
  • Reverse engineer, decompile or take apart the Service, except where the law allows it.
  • Disrupt or overload the Service, or try to access accounts, systems or data that aren't yours.
  • Upload anything that's illegal or infringing, or that contains malware.

Your content

You keep ownership of what you add to the Service, such as place names, your lower-third text and your logo. You give us a limited permission to store, process and display it only to run the Service for you. You confirm that you have the rights to upload it.

Our rights

The Service, including its software, design, graphics, broadcast layouts, the WeatherVector name and logo, and the Vector Threat Index, belongs to us and is protected by law. As long as you follow these Terms, we give you a personal, revocable license to use the Service. You can't transfer this license to anyone else, and it isn't exclusive. Any rights we don't expressly give you are kept by us.

If you send us ideas or feedback, we may use them without owing you anything.

Third-party data and services

The Service shows data from outside sources, such as NOAA, the National Weather Service, the Storm Prediction Center, the National Hurricane Center, NASA, the Iowa Environmental Mesonet and map providers. We don't control these sources and aren't responsible for their accuracy, availability or changes. Some data has its own terms or attribution requirements, which are listed on our support page. Links to other websites are for your convenience, and we're not responsible for them.

Changes to the Service and these Terms

We're always improving WeatherVector, so features may change, and we may pause or stop parts of the Service. We may also update these Terms. If a change is significant, we'll tell you in the app or by email before it takes effect. Continuing to use the Service after the change means you accept the new Terms.

Ending your use

You can stop using the Service and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other users. Where it's reasonable, we'll tell you first. If we close a paid account without cause, we'll refund the unused part of your current billing period. Sections that by their nature should continue, such as disclaimers, limits on liability and disputes, still apply after your use ends.

Disclaimers

THE SERVICE AND ALL WEATHER INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE OR ITS DATA WILL BE ACCURATE, COMPLETE OR AVAILABLE WHEN YOU NEED IT, OR THAT ALERTS WILL BE DELIVERED. YOU USE THE SERVICE AT YOUR OWN RISK.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THIS INCLUDES PERSONAL INJURY, PROPERTY DAMAGE, AND LOST PROFITS OR DATA, ARISING FROM WEATHER EVENTS, DECISIONS MADE USING THE SERVICE, MISSED OR LATE ALERTS, OR THE SERVICE BEING UNAVAILABLE OR INACCURATE. THIS APPLIES EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WON'T BE MORE THAN THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50, WHICHEVER IS GREATER.

Some places don't allow certain warranty exclusions or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits liability that can't be limited by law.

Indemnity

If you use the Service in a way that breaks these Terms or the law, including content you broadcast or upload, you agree to cover our reasonable costs and losses from any resulting third-party claims, including reasonable legal fees.

Disputes and governing law

If you have a problem with the Service, please email us first. Most issues can be sorted out quickly that way. These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law rules. Any dispute that can't be settled informally will be handled in the state or federal courts located in Alabama, and both sides agree to those courts' jurisdiction. Either side may bring a qualifying claim in small claims court instead. If you're a consumer in a country that gives you the right to bring claims in your local courts, or protects you with mandatory local law, nothing in these Terms takes those rights away.

App store terms

If you downloaded WeatherVector from the Apple App Store, Google Play or the Microsoft Store, the store's own terms also apply. If you use the iPhone or iPad app:

  • These Terms are between you and WeatherVector only, not Apple. Apple isn't responsible for the app or its content.
  • Your license to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app, as far as the law allows.
  • Apple isn't responsible for handling any claims about the app. This includes product liability claims, claims that the app doesn't meet legal requirements, consumer protection or privacy claims, and claims that the app infringes someone's intellectual property.
  • You confirm that you're not in a country subject to a US government embargo, and you're not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

General

These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a right, we're not giving it up. You can't transfer these Terms to anyone else without our permission. We may transfer them as part of a merger, sale or reorganization. We're not responsible for delays or failures caused by events outside our reasonable control, including severe weather, power and network outages, and failures of government data feeds.
